The lower costs and effort needed to recruit boomerang employees can save companies up to $20,000 per hire. There’s a reason companies have been wary of these workers in the past though. Boomerang employees can cling stubbornly to old ideas, expect perks or increased compensation from their original tenure or bring back past friction with other employees. There’s no guarantee that they’re the best candidate in your pipeline for a certain position, and they also decided to leave once before. Who’s to say they won’t do it again? Can a Prospective Employer Demand Access to an Applicant’s Facebook Account - Pathfinder Careers Can a Prospective Employer Demand Access to an Applicant’s Facebook Account? This post generously provided by Dee Rubanoff, an attorney at  Williams, Zografos Peck  in Lake Oswego, OR which represents employers. Employers are reportedly engaging in “shoulder surfing” during job interviews, meaning that they require an applicant to access his or her Facebook account for viewing during a job interview.   The issue of whether this is lawful has been percolating for a while in the media, and it is a hot button issue for the American Civil Liberties Union (ACLU), but there does not appear to be any established case law yet. Obviously, the uncertainty only relates to non-public information that is intended for a person’s select group of “friends.”   Nothing prevents a prospective employer from accessing publicly available Facebook information about an applicant, even though it may be unwise from a human resources standpoint. The ACLU maintains that requiring access to a Facebook account is an invasion of privacy, but it is unlikely that this would support a legal claim in court, because people who post information on their Facebook pages have no control over whether their friends will share the information with third parties.   Accordingly, they do not have the “reasonable expectation of privacy” that is required for an invasion of privacy claim. There is also an argument that it violates the Facebook Terms of Use, but that may depend on what the prospective employer actually requests.   For example, a Facebook user promises not to allow third parties to access the account, or provide account information such as passwords.   However, the Terms of Use don’t appear to prevent a prospective employer from asking the applicant to “friend” the interviewer.       If that happened during an interview, there would be no opportunity for the applicant to delete sensitive material before it is viewed. In my opinion, the most interesting aspect of this issue involves the Stored Communications Act, a federal law that prevents “unauthorized” access to electronically stored information.   In a case out of New Jersey, an employer was found liable for violating this law after an employee was asked to provide access to a private chat room that she shared with other employees.   She did so, and two other employees were fired for negative comments that they made about the company.   At trial, the company managers claimed that the employee voluntarily consented to provide access to the chat room, but the employee testified that she felt pressured to do so.   The jury found that the consent was not voluntary. Some legal experts have taken the position that this rationale would not apply to job applicants, because they are free to refuse and only risk losing the job prospect.   I’m not convinced that a court would make that distinction between job applicants and current employees, particularly in light of the current job market and how desperate applicants may be to obtain a job. So, what should you say if a prospective employer asks you for access to your Facebook account?   As discussed above, you could decline on the basis that it would require you to violate the agreement you made with Facebook, and hopefully the interviewer will not attempt to get around this by asking to be “friended.”   You can also decline on the basis that your friends expect you to keep their information confidential. As a last resort, you can politely ask whether all applicants are being requested to provide this information, and whether there is something about the job position that puts your personal life in issue.   You should follow this up by reassuring the interviewer that you have nothing to hide and you would be happy to answer any questions about your lifestyle or background that are “job-related.”   If the prospective employer persists, then it’s time to consider how much you want the job, and whether you will be comfortable working for an employer that makes this a condition of being hired.

Badass rock star, take it away! Why did you decide to work with me? I think even back in 2011, you were a career coach to the stars. And your cheerful, fun and compassionate style jived with me immediately. I was living and working very much in the muggle world and I knew that I had a creative career wanting to burst open inside of me. I had no idea what or how, and ZERO confidence, and somehow knew that youd be the one to unlock it for me. What were you doing work-wise when we started working together and what are you doing now? Back then, which feels like several lifetimes ago, I was a graduate student in public health and research assistant. Now, Im lets see if I can remember them all a writer who has published on national publications, a marketing consultant, an artist whose work has been featured on HuffPo and made into a clothing line, a fortuneteller, a teacher, and oh, right, a hypnotist. What was your biggest takeaway from our work together? Honestly, aside from all of the immensely practical tools that you shared to help me figure out what the heck I want, it made such a big difference to have someone believe in me as much as you did. After working with you, I completely shed the fear that I was uniquely incapable of achieving a creative career. Think of someone who is currently in the shoes you wore when we first started working together. What advice do you have for her? You have NO. IDEA. what youre capable of. And I dont say that just to make you feel better. You literally have no idea. You are going to go through so many iterations of growth and transformation, and thats going to rewire your brain several times over. The definition of being in a starting position is that you dont know whats ahead, and thats okay and normal. The only thing you can do is put one foot in front of the other. But you, dear dreamer, have an advantage over those who arent connected to their creativity and only know push push push and hard work. If you commit to a dream, open yourself to surprise and keep showing up, the universe will rally to your aid. That, I know. Oh, also if you feel like, three years after beginning your journey toward your dream, everything has fallen apart and you think the universe has shown you abundant evidence that you were never meant for this, and you fall into a deep depression, breathe a sigh of relief. Youre almost there. Really. Keep going. Something amazing is just around the corner. Is there anything thats been a game-changer for you when it comes to your business that you can share? Wed love a good resource or a mindset/productivity tip! The biggest idea thats transformed my work and life is a framework that Ive developed and dubbed The Garbage Method. (Yeah, Im writing a book on it.) Mind you, the idea isnt new. But the way I frame it is. So many of us are stalled by ideas of what we *should* be achieving that we set impossible, setting ourselves up for failure. Im only starting my business now and I want to hit six figures within a year! Im only now learning to make leather bags and they should look more or less like what Id be in a store! Um, I dont think so! And those of us with perfectionistic streaks also tend to be smart and talented, so its so easy for us to buy into the illusion that we *should* be measuring up to those sky-high standards we set for ourselves all the time. Nothing could be further from the truth. What prevents us from doing great work and achieving big success is not our latent ability or work ethic. Ever. But its that we set ourselves up for stress and failure by setting the goals too high and making the whole thing feel like an ordeal. This is the Garbage Method in a nutshell. Pick a garbage goal. Want to be a handbag designer? Walk into your studio and think, Im going to make an ugly-ass, craptastic bag today. Are you an aspiring life coach? Find someone to coach, and think, My goal is to do a fifty mediocre sessions so that I can get it all out of the way. Heres one mediocre, forgettable session! The garbage goal is going to make you laugh. Its going to go against your perfectionist instinct. Its going to relieve the pressure in a major way. Instead of tensing up, it will relax you. Most importantly, you will meet the goal. And it will feel like a pleasure, because it was not hard. You will have enjoyed yourself. And the next day, youll be ready for more. Your creativity will loosen. If you keep garbage-ing it, before you know it, youll be in the flow, making genius work happen. I promise. The only person who can make their crazy dreams come true is one who can laugh at herself, enjoy the damn work and have a good day, everyday. If it feels hard, remember to garbage it up.
